Youtubeify provides fully managed YouTube channel services, including but not limited to channel creation, content production, video publishing, and ongoing channel management. Our services are designed to help entrepreneurs launch and scale their YouTube channels as digital assets.

3. Eligibility

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Account & Application

When you submit an application or create an account with us, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your account credentials confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to reject any application or terminate any account at our sole discretion.

5. SMS Messaging Terms

Program Description: We offer two SMS messaging programs: (1) transactional messages for appointment reminders, onboarding updates, application status notifications, booking confirmations, follow-up messages, and account alerts; and (2) marketing messages for special offers, discounts, service updates, and promotions.

Consent: You may opt in to receive SMS messages by checking the appropriate consent checkbox(es) on our website. Consent is not a condition of purchase or using our services.

Frequency: Transactional message frequency varies based on account activity. Marketing messages may be sent up to 8 times per month.

Costs: Message and data rates may apply depending on your mobile carrier. Youtubeify does not charge fees for SMS messages.

Opt-Out: Reply STOP to any message to unsubscribe. You will receive a single confirmation of your opt-out.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.

Privacy: Your phone number and SMS consent data will not be shared with third parties for marketing purposes. For full details, see our Privacy Policy.

6. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Youtubeify LLC or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

7. User Conduct

You agree not to:

• Use our services for any unlawful purpose
• Provide false or misleading information
• Interfere with the proper functioning of our website or services
• Attempt to gain unauthorized access to our systems
• Harass, abuse, or harm others
• Violate any applicable laws or regulations

8. Payment Terms

If you engage our services, you agree to pay all applicable fees as outlined in your service agreement. Payment terms, including pricing, billing frequency, and accepted payment methods, will be specified in your individual service agreement.

All fees are non-refundable unless otherwise specified in your service agreement or required by law.

9. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

No Guaranteed Results: While we strive to help you build a successful YouTube channel, we do not guarantee any specific results, revenue, or profits. YouTube success depends on many factors beyond our control, including market conditions, content performance, and your own efforts and decisions.

We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUTUBEIFY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Youtubeify LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may terminate or suspend your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website with a new effective date. Your continued use of our services after any changes constitutes your acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
